One of the most common questions we get asked here at Super Spaces is ‘do you need planning permission for a garden room?’ and the answer is not always a simple yes or no. There are a number of different rules to follow when it comes to building on your land without planning permission.
The good news is that Super Spaces garden rooms do not usually require planning permission as they are classed as outbuildings, so we can create one of our beautiful outdoor garden buildings in your home as long as certain rules are met.
Permitted development rules cover outbuildings, including garden rooms, which are ‘incidental’ to the main dwelling. Essentially this means that their use is a minor accompaniment to the main house.
A rule of thumb is that modern garden rooms do not usually require planning permission as outbuildings fall within permitted development rules which are:
1) That the constructed garden building is no higher than 2.5m from the bottom of the building to the top of the roof (if within 2m of boundary)
2) That you do not take up more than 50% of your garden area with the garden building
3) The garden building is not to be used as living or sleeping accommodation
4) The garden building doesn’t have a balcony, veranda, or raised platform.
If your proposed garden building plans are compliant with all the criteria listed above, there is no reason why you should need planning permission. However, if you live in a listed building or your home is in a designated area (eg a National Park, area of outstanding natural beauty (AONB), conservation area, or World Heritage Site then you will certainly need permission but otherwise it is highly unlikely. I know it should go without saying but flats and maisonettes don’t have permitted development rights.
